These Terms of Use (the “Terms”) are a licence agreement between you and ART APP LTD (“we”, “us”) for the Temfy - Habit Tracker mobile application for iOS and Android (the “App”). By installing or using the App you agree to these Terms. If you do not agree, please do not use the App.
If you downloaded the App from the App Store, Apple’s Standard Licensed Application End User License Agreement also applies; where it conflicts with these Terms, Apple’s agreement prevails for the App Store version.
1.1. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your personal, non-commercial use, in accordance with these Terms.
1.2. Free version. The App can be used free of charge with limited features (up to two habits, no home screen widgets).
1.3. Habit Tracker Pro. Habit Tracker Pro removes the habit limit and unlocks widgets. On iPhone it is an auto-renewing subscription bought in the App through the App Store and charged to your Apple ID. The price in your local currency, the billing period and any free trial are shown in the App before you buy. The subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period in your Apple ID settings (Settings → your name → Subscriptions). Refunds for App Store purchases are handled by Apple at reportaproblem.apple.com. On Android, Habit Tracker Pro can be bought on the website (section 1.4).
1.4. Buying on the website. You can also buy Habit Tracker Pro as an auto-renewing subscription on temfy.app/habits/premium/; the payment is processed by Stripe. The price, currency and billing period are shown before you pay. The subscription renews automatically at the end of each period and is charged to the same card until you turn off auto-renewal on the Manage subscription page; access then stays until the end of the paid period. You can ask for a full refund within 14 days of your first payment by emailing artappltd@gmail.com. To use Habit Tracker Pro in the App, sign in there with the same Apple ID or Google account you used on the website, or enter the activation code shown after payment.
1.5. The set of features in the free version and in Habit Tracker Pro may change; the current list is shown in the App before purchase.
You may not, yourself or through others: copy, modify or distribute the App except as allowed by law; reverse engineer, decompile or disassemble it except to the extent the law expressly permits; use the App to build a competing product or service; or remove or alter any trademark, copyright or other notice in the App.
3.1. The App does not require an account. Your habits, check-ins, reminders and notes are stored on your device (and, if you turn it on, in your own iCloud or Android backup). We do not have access to them.
3.2. Deleting the App deletes the data stored on your device. We cannot restore it unless it is kept in your own backup, so please keep backups turned on if your history matters to you.
3.3. How we process data is described in our Privacy Policy.
We may update the App, change or remove features, or stop providing it. Reminders depend on your device’s operating system and notification settings, so we cannot guarantee that every reminder is delivered on time.
5.1. We provide the App with reasonable care and skill. Apart from that, and to the extent permitted by law, the App is provided “as is”.
5.2. We are not liable for losses that were not reasonably foreseeable, for business losses, or for losses caused by events outside our reasonable control. Our total liability to you in connection with the App is limited to the amount you paid for Habit Tracker Pro in the 12 months before the claim.
5.3. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or any other liability that cannot be limited or excluded by law. If you are a consumer, nothing in these Terms affects your statutory rights.
You can stop using the App at any time by deleting it; an App Store subscription is cancelled in your Apple ID settings, a website subscription on the Manage subscription page. We may end your licence if you seriously breach these Terms. Sections 3, 5 and 7 continue to apply after these Terms end.
These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere in the UK or in another country, you also keep the protection of the mandatory laws of your country and may bring proceedings in your local courts. If you have a problem, please contact us first — most issues can be solved quickly by email.
We may update these Terms. The current version is always available at temfy.app/habits/terms.html; for significant changes we will also let you know in the App. If you keep using the App after a change takes effect, the updated Terms apply.
